When I started Residencias Los Jardines, I started writing a weekly newsletter -determined to tell all the good, bad, and the ugly. I knew some readers would be interested in the construction process. I expected others might be interested in the lifestyle of two people who had decided to live outside the box. For others, the adventures of Lita, the parrot and the cat took on an entertainment saga all its own.

Residencias Los Jardines is finished. We periodically have re-sales and rental availability. Some readers may be interested in this information.

Our Lives

Weather: Windy, windy, windy, and cold (for us) --we continue to receive an almost daily dusting of volcanic ash.

FUN STUFF:

Fun Stuff #1: We were invited to friends house in Tambor. We hadn't been there for 10 years at least... this was a chance for us to go... We enjoyed ourselves large because of the company, accommodations, AND one goofy outing.

When there, I received a notice of an unreserved auction on a nearby house... I have never seen an auction here in CR and I had never envisioned a house that was being "auctioned". Since it was just down the road, I made an appointment and sent notices to my rich friends to pull out their check books... well none did but viewing the house was an experience which kept three of us talking for two days... every thing was simply beyond imagination... absolutely incredible... but the question which keep nagging us was, why would anyone build this magnificent house in the middle of nowhere, with difficult land access and better accessed by helicopter... I still don't understand it but I have seen lots of mistakes here... this house is about 8 yrs finished, originally listed for $8m and now "valued" (by some one) at $6.5 mil... up for international "unreserved" action on Jan. 31... According do our summation of interest, they had had one helicopter visitor... no one else that we could tell. While it is "unreserved" they do reserve the right to withdraw it from the market if they do not get ???? price... here is a link to the website: https://www.conciergeauctions.com/auctions/villa-paraiso-montezuma-costa-rica... While the agent didn't reveal the owner, we were able to find out, Googled him, and just wonder...why he did this... but if any of you readers feel so inclined, sign up, submit a bid, and if successful, invite us back. The property is certainly INCREDIBLE... views, construction, details, features, etc... and comes with at least one very competent and very necessary smart, organized master staff member... she could make life easier... just in case you were wondering...

Fun Stuff #2: A former tenant was the project director of a hydro electric project in CR... We got to know him and found he and his wife very interesting people... both had worked many project around the world, had lots of experience, and are wonderful story tellers. He had offered to take me to the current project and today he came through. I love seeing projects like this and knowing the guy who put it all together, listing to the stories that happen spontaneously as we walk around about how things went right or as is usually the case didn't work right, engineering screw-up, contract screw up, sourcing problems, unexpected issues... k The company is an infrastructure company, NY stock exchange, with project all over the world... this being a very small one and at 250% over budget, not a very successful project... It was suppose to be finished 2.5 years ago... he just signed of on in Dec 9... On Dec. 10, they company was to loose their water rights... wow... calling things close.!!!

(1) Prosecutor’s Office to charge 26 people for failed border road project

Costa Rica’s General Prosecutor Jorge Chavarría Guzmán says he is ready to present the biggest indictment in Costa Rican history: charges against 26 people for irregularities committed in the failed construction of a road along the border with Nicaragua.

At a press conference on Tuesday, Chavarría said that shoddy work on “La Trocha” (“The Trail”), a failed project, meant to provide a crucial piece of infrastructure for a poor region, caused economic losses for the country of some ₡1.2 billion ($2 million).

The list of those indicted includes three former National Roadway Council (CONAVI) officials, 18 private contractors, three men who impersonated CONAVI inspectors, and the wives of two of the indictees.

They will face assorted charges of influence peddling, bribery, corruption, embezzlement, concealment of assets and money laundering, among others.

The chief prosecutor said the investigation found that the three CONAVI officials conspired with private contractors to charge the government for the alleged use of construction equipment for works that never took place. That equipment was actually being used on other projects, some of them in other countries, at the time they were supposed to be at the border road, he said.

Chavarría said that at the trial, prosecutors will present evidence collected over five years, including 668 volumes of documents, 86 reports from the Judicial Investigation Police, 50 files containing invoices, 40 boxes of documents seized during 58 raids and statements from 250 witnesses.

Washed away
President Laura Chinchilla Miranda (2010-2014) approved the construction of the 160-kilometer road to facilitate the transit of residents from border communities who faced problems because of frequent invasions by the Nicaraguan army into Costa Rican territory.

Starting in 2010, Nicaraguan soldiers prevented Costa Ricans from navigating the San Juan River, a natural border between the two countries. The river was the only transportation route for many local residents in northern communities.

Chinchilla’s administration launched the construction of Route 1856 — the project’s official name — in December 2010. She granted the project to private contractors without going through a public bidding process as required by law.

At the time, she justified her decision because of the emergency situation that border residents were facing due to the actions of the Nicaraguan soldiers.

Chinchilla inaugurated the road in February 2012, despite claims from local residents that the work was far from complete.

Subsequent inspections by experts from the University of Costa Rica released in May of that year found that shoddy work on the road’s drainage systems could leave the road in danger of collapsing during the rainy season.

Those predictions turned out to be correct. The first rains of the season washed away several stretches of the road and various bridges collapsed.

In May 2012, Chinchilla said that CONAVI officials had received bribes from private contractors and construction equipment suppliers to secure contracts for the project.

The scandal prompted President Chinchilla to order the removal of Public Works and Transport Minister Francisco Jiménez, CONAVI Executive Director Carlos Acosta and several other public officials.

(2) Finance minister says he warned of possible cut in debt rating

The finance minister is blaming the legislature for not passing more taxes after the Fitch rating firm cut the ranking on the government’s debt from junk bond to even junkier bond.

The rating went from BB+ to BB. The company considers that bonds in both categories are speculative for investors.

Helio Fallas, the minister of Hacienda, was quick to issue a statement in which he said he had reminded government officials of such a development if the various tax bills were not approved.

He also is the first vice president of the country.

Despite some improvement in 2016, Fitch, one of the world’s three top rating agencies, said the fiscal deficit is expected to rise over the next two years as a result of a higher interest burden and spending rigidities. The government's tax reform proposals to rein in the fiscal deficits have made little progress in the legislature given its fragmented structure and the umbersome legislative process, it added.

The result of the rating cut is that Costa Rica will have to pay higher interest when it floats more bonds. Nearly half of the national budget is financed with borrowed money.

The government has been seeking a value-added tax and increases in income tax rates, among other revenue proposals. Some lawmakers were unhappy when President Luis Guillermo Solís presented a national budget proposal 12 percent higher than the previous year instead of making steep cuts.

Fitch said that the outlook for passage of a crucial value-added and income tax proposals, estimated to provide close to 2 percent of gross domestic product in additional revenues, has significantly diminished as the February 2018 congressional and presidential elections approach. Fitch's new baseline scenario does not incorporate passage of any meaningful tax reform measures in the forecast period through 2018, it said, adding that as a result of the large fiscal imbalances, Costa Rica's debt burden has risen rapidly over the last decade.
